Outsourcing is not a cost decision, although it is usually sold as one. It is a decision about which knowledge you are content to hold outside your company. Some knowledge is genuinely fine outside: how to build a standard integration, how to ship a mobile app. Some is not, because it is the thing you compete on. Getting that line right matters more than the hourly rate on either side of it.
Outsourcing software projects: decide whether you are buying a project or a team
These are different purchases with different failure modes. Buying a project transfers delivery risk to the vendor and works when the requirements are genuinely stable, which is rarer than anyone admits. Buying a team keeps the risk with you and works when the requirements will move, which is most of the time. Most disappointment in outsourcing comes from buying a fixed project for work that was always going to change, then paying for each change twice: once in money and once in the relationship.
Commissioned software is not a work made for hire, and the contract has to say so
This is the most commonly mishandled clause in the category. Under 17 USC 101, works prepared by an employee within the scope of employment are works made for hire automatically, but a specially ordered or commissioned work only qualifies if the parties expressly agree in a signed written instrument and the work falls into one of nine listed categories. Software is not one of those nine. A contract that relies on a work made for hire label alone may therefore leave copyright with the vendor, so what you want is an express written assignment of copyright, plus a waiver or licence for moral rights where relevant.
How to outsource software development and keep the knowledge that has to stay yours
Whatever the engagement model, insist on three things that survive the vendor. The repository, build pipeline and cloud accounts belong to you and vendor staff have access rather than ownership. Architecture decisions are written down in your repository, not in the vendor's wiki. And at least one person on your side can explain how the system works without phoning anybody. Teams that hold those three can change supplier in a quarter; teams that do not are renewing at whatever the vendor asks for.
What the arithmetic of software outsourcing solutions actually looks like
Compare fully loaded costs rather than hourly rates. Against a US median annual wage that BLS puts at $135,980 for software developers in May 2025, an offshore rate can look transformative, and then coordination overhead, rework, your own management time and the cost of a slower feedback loop close some of that gap. The honest way to model it is to assume a productivity discount and a management tax, put your own numbers on both, and see whether the decision still holds. If it only works at zero overhead, it does not work.
